When you buy insurance in Texas, your insurance carrier is required by law to provide you with uninsured and underinsured motorist (UM/UIM) coverage unless you opt out by signing a waiver. You may have this personal injury coverage without even realizing it.

If your insurance company tells you that you do not have UM/UIM coverage, attorney Randall D. Moore will ask the company to provide a copy of this waiver. If the insurance company cannot, we can compel the insurance company to provide you with this coverage retroactively, even if you did not pay for it.

While a UM/UIM claim is filed against your own insurance company, you should still seek the assistance of an experienced attorney. Your insurance company assumes an adversarial role when you file a UM/UIM claim. It is likely to offer you far less than your claim is worth — and may even deny your claim if you do not follow the correct procedures. Also, your Texas Supreme Court has issued several rulings favoring insurance companies, which is no surprise to us, in this area. Your insurance company is now allowed to deny your UIM claim, require you to hire an attorney and sue the at-fault driver, obtain a judgment, obtain a jury finding of damages, and then submit the claim to it for payment no matter how obvious the UIM coverage should be. The penalty for being wrong in denying any UIM claim is very minimal to the insurance company based on your Texas Supreme Court’s rulings.
